Acceptance of Terms of Service
By using www.vialibri.net (viaLibri) you agree to all the terms and conditions of service included in this document. If you violate any of the terms of this agreement viaLibri may, at its own discretion, terminate access to any service it provides, either free or paid. The charges for any service terminated due to violation of the terms of this document will be reimbursed on a pro-rata basis.
Indemnification
By using viaLibri you agree to waive and hold harmless viaLibri Limited, its employees and affiliates, from all liabilities, claims and damages relating to the information available on www.vialibri.net, the merchants represented there, the merchandise that may be found there or purchases of such merchandise. Any use of this site constitutes acceptance of these terms.
Use
The content and information on viaLibri is subject to copyright and is provided for personal and individual use only. It cannot be republished, sold or re-issued for any purpose without written consent from viaLibri.
Possession and ownership of items
viaLibri does not own or have physical possession of any item or items listed for sale on its website. None of the items appearing for sale are the property of viaLibri, unless explicitly claimed as such. viaLibri provides no warranties, expressed or implied, regarding the legal ownership of items whose descriptions may appear on its site.
Automated Access
The unauthorised use of search functions by robots and other automated, programmed or script-driven methods of access is strictly forbidden. Excessive use that is indicative of automated searching may result in termination of access.
Accuracy of Content
viaLibri cannot guarantee or verify the accuracy, completeness or timeliness of any information presented on its site. The accuracy of content is the sole responsibility of the person, business or organization that is identified as its source. Information regarding the value, marketability or rarity of any object reported for sale on viaLibri is solely the opinion of the merchant who has offered it for sale. viaLibri makes no representations regarding the fair market value of any of these items. Determinations of that nature should be sought from qualified specialists in the specific type of material for which a valuation is required.
Removal
While it accepts in good faith that its content providers make adequate effort to verify the accuracy of the information they provide, viaLibri reserves the right to remove from its site any information which, in its sole judgement, is inaccurate, inappropriate, objectionable or not in keeping with its requirements.
Requests for Removal of Content
Some information presented on viaLibri is transferred to its users instantaneously, as received, from various content providers. viaLibri cannot modify or delete this information, and any modification to such information is the sole responsibility of the original content provider and not viaLibri. In the case of items that have already been sold but still appear in our search results we will continue to show these books as being for sale until they have been removed from the data provided by our content providers. In some cases there may be a delay between the time when an item is first reported to us as sold and the time when we are able to remove it from our listings. viaLibri does not remove information at the request of third parties. Requests for removal must be received from the individual or organisation that has provided the information to us.
Links
Content displayed on the viaLibri website may include links to other websites operated by third parties. viaLibri does not control and has no responsibility for the content and features that will be found on independent sites that may be reached by links we provide. Any questions regarding the information found on these sites should be directed to them and not to us.
Paid Content
viaLibri accepts payment from some of its content providers in return for presenting to its users the information they provide. viaLibri reserves the right to remove such paid content for any reason without any obligation other than return of payment for any services not rendered.
Changes of Content and Features
The sources, availability, features and functionality of the services and content offered on viaLibri are subject to change without notice. If any conditions cited by our Terms of Service shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
Warranties
All information, features and services available on viaLibri are presented strictly “as is” and are provided without warranty, express or implied.
Paid Services
Paid subscriptions to Premium Services are provided without warranty and may be cancelled at any time. Refunds will be paid to subscribers for any pre-paid quarterly subscription period that has not yet begun as of the date of cancellation notification. Quarterly subscription periods begin on the day that a subscription first becomes active and are renewed every three months on that day of the month. Annual subscriptions may also be purchased.
Notice
Notice of violations of any terms of service may be made to you by email, postal delivery, or display of notice directly on the viaLibri website.
Communications
When you visit vialibri.net or send emails to us, you are communicating with us electronically. Communications sent to viaLibri by means of the Web Site or e-mail are not considered delivered or effective unless and until they are actually received and processed by viaLibri’s responsible representative. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on the Web Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Showcase Exhibitors
Appearance as an exhibitor in the viaLibri Virtual Showcase is subject to approval and granted solely at the discretion of viaLibri Limited. Exhibitors must be established professional antiquarian booksellers, at least 18 years of age and legally permitted to operate a business in their respective jurisdictions. Each exhibitor must provide accurate, current, and complete information during registration and is responsible for maintaining and updating this information. Any exhibitors whose registration is rejected by viaLibri will receive a full refund of any registration fees.
Exhibitors are responsible for ensuring all content, including but not limited to, images and descriptions, complies with applicable laws and does not infringe on the rights of others. Prohibited content includes:
- Infringing, defamatory, libellous, or otherwise unlawful content.
- Material containing false or misleading information.
- Offensive, discriminatory, or inappropriate content.
All items listed by the exhibitor in the showcase must be described accurately, and any photos shown must be of the item in question.
Exhibitors are required to fulfil orders in a timely manner and provide customer service according to industry standards. Any delays or issues with order fulfilment must be communicated promptly to the customer. Exhibitors are responsible for handling returns, refunds, exchanges, and customer complaints.
Exhibitors must own or have the rights to all content and products they display or sell during the Showcase. By participating, exhibitors grant viaLibri a non-exclusive, royalty-free, worldwide license to use, display, and promote their content for the duration of the Showcase, and for the purpose of promoting future Showcases.
Exhibitors must conduct themselves in a professional manner and interact respectfully with customers, other exhibitors, and event organizers. Harassment, abusive language, or other unprofessional behavior is grounds for immediate termination of participation.
Exhibitors are responsible for handling customer data in compliance with all relevant privacy laws and regulations. Any misuse of personal data collected through interactions with customers, including unauthorized selling, sharing, or marketing, is strictly prohibited.
viaLibri will not be held responsible for any disputes between exhibitors and customers, losses due to technical issues, or damages arising from exhibitors’ non-compliance with these Terms. Exhibitors agree to hold the event organizers harmless from any claims or liabilities resulting from their participation.
The organizers reserve the right to terminate an exhibitor’s participation at any time for violations of these Terms or any other reason deemed necessary to maintain the integrity of the event. Refunds of registration fees, partial or complete, may be granted at the sole discretion of viaLibri.
Exhibitors have the right to withdraw their participation at any time. By requesting withdrawal, exhibitors acknowledge that they forfeit their reserved space and will not be eligible for re-entry in that Showcase. If the exhibitor decides to withdraw before the Showcase officially opens then viaLibri will issue a full refund of any registration fees paid. Those withdrawing after the opening of the Showcase may recieve a partial refund, but this is granted at the sole discretion of viaLibri.
